Introduction and Acceptance of Terms
These Service Terms ("Terms") govern access to and use of the Auto TextBack mobile application ("App" or "Service"), provided by Mesensei Oy ("Provider", "we", "us"). The Service is distributed as an Android application through Google Play.
By downloading, installing, or using the App, you ("User", "you") accept these Terms in full. If you do not agree to these Terms, you must not download, install, or use the App.
What you are buying. Auto TextBack is a simple, low-cost application sold for a one-time price and intended to be used as is. It comes with no service level agreement, no uptime or delivery commitments, and no warranties beyond those that cannot be excluded under mandatory consumer protection law. If you need a service level agreement, warranties or uptime commitments, please contact Mesensei Oy's sales team at hello@mesensei.com. Such services are offered at enterprise pricing, must be agreed separately in writing, and are not covered by these Terms.

Data Protection Notice and Personal Data
The App is designed to operate entirely on your device, without a backend server, user accounts, analytics, or advertising. How personal data is handled in connection with the Service is described in the Auto TextBack Data Protection Notice, which is included in the App (About › Data Protection Notice) and forms part of these Terms by reference.
Purpose and Description of the Service
Auto TextBack is an Android application available through Google Play. When you miss an incoming phone call, the App automatically sends the caller a text message (SMS) that you have written in advance. The SMS is sent from your own phone number, through your own mobile network operator, and at your own cost. A longer message may be split into several SMS parts, each of which may be charged separately by your operator.
The App runs entirely on your device. There is no backend server, no user account, no analytics, and no advertising. All settings, including your auto-reply message, are stored locally on your device.
The App allows you to configure:
- a cooldown period per phone number (between 5 minutes and 48 hours) before another automatic reply is sent to the same number;
- daily and monthly limits on the number of automatic SMS messages sent;
- paused hours during which no automatic replies are sent.
The first three automatic replies are provided free of charge. Continued use beyond this requires a one-time purchase ("unlock") made through Google Play, as described in "Price and Payments".
User Roles and Use of the Service
The Service is intended for individuals and professionals who install the App on their own Android device.
Callers who receive an automatically generated SMS are not users of the App, do not interact with the Provider, and are not party to these Terms. The User who configures and sends the automatic reply is solely responsible for that communication, as described in "User Content and Communication".
The Service is not intended for use by minors. By using the App, you confirm that you are of legal age and legally capable of entering into this agreement under the laws applicable to you.
Price and Payments
Free Trial with No Obligation to Buy
The first three automatic replies sent through the App are provided free of charge, with no obligation to purchase anything.
Paid Unlock
Continued use of the automatic reply feature beyond the initial free replies requires a one-time purchase of a non-consumable "unlock" through Google Play. This is a single purchase, not a subscription.
Payment is processed by Google Play under Google's own payment terms (Google Play Terms of Service). The Provider does not directly process or store your payment details.
Refunds: Refunds are handled according to Google Play's refund policy. You may also contact the Provider at hello@mesensei.com regarding a refund request, and the Provider may process a refund through Google Play where appropriate. Nothing in these Terms limits any statutory consumer rights you may have regarding refunds or withdrawal under applicable law.
Operator charges: Any SMS charges billed by your mobile network operator for messages sent through the App (including split messages) are your sole responsibility under your own contract with your operator. These charges are not paid to, controlled by, or refundable by the Provider.
Updates and New Features
The App is sold as a one-time purchase through Google Play. For as long as it is commercially viable, the Provider will keep the App available on Google Play and supported with the updates required for security, for compatibility with new Android versions, and to meet Google Play requirements. These updates are free of charge.
If the Provider discontinues the App, you may continue to use the version you have purchased for as long as your Android operating system supports it. After discontinuation, the Provider does not guarantee further updates or downloads, free or otherwise. This does not limit your rights under mandatory consumer protection law.
The Provider may introduce new features, which may require a separate purchase.
User Content and Communication
The only content you submit through the App is the auto-reply message text that you write. This content:
- is stored locally on your device, not on any server operated by the Provider;
- is sent as an SMS, through your own phone number and operator connection, to any caller whose call you miss while the automatic reply feature is active;
- is chosen entirely by you, and you alone determine its wording, tone, and the circumstances in which it is sent.
The Provider never accesses, views, stores, reviews, or checks the content of your auto-reply message or of any SMS sent through the App, because the App does not transmit this information to the Provider.
You are solely responsible for the content of your auto-reply message and for the consequences of sending it to any caller, including compliance with applicable law on unsolicited communications, advertising, and consumer protection.
Customer Communication and Marketing
By using the App, you agree to these Terms and the Data Protection Notice. If you contact the Provider about its products, ask for assistance, request new features or suggest improvements, the Provider may reply to you and tell you about new versions of the App. This is normal customer relationship management, as described in the Data Protection Notice.
The Provider does not send unsolicited marketing emails. You can always opt out of the Provider's messages and object to the use of your personal data for marketing and communication purposes by making this request in writing to hello@mesensei.com.
Acceptable Use
You may use the App only to send automatic SMS replies to missed calls on your own phone number, lawfully and in line with these Terms. You must not use it to:
- send spam, advertising or marketing messages;
- harass, threaten, defame or unlawfully target anyone;
- send content that is unlawful or infringes anyone's rights.
You must not reverse engineer the App or interfere with its security or with Google Play, except where mandatory law allows it.
Set your cooldown, limits and paused hours with care to avoid unintended messages.
Third-Party Services
The App relies on, and is distributed through, third-party services that are not operated by the Provider:
- Google Play handles distribution of the App, payment processing for the one-time unlock purchase via Google Play Billing, and may prompt you to rate or review the App via Google Play In-App Review. Google Play is governed by Google's own terms and policies.
- Your mobile network operator carries and charges for the SMS messages sent through the App, under your own contract with that operator.
These third-party services are provided under their own terms, outside the control of the Provider. The Provider is not responsible for the availability, performance, security, billing accuracy, or content of these third-party services.
Mobile Application License and App Store Terms
Subject to your compliance with these Terms, the Provider grants you a personal, non-exclusive, non-transferable, revocable license to download, install, and use the App on an Android device that you own or control, solely for your personal or professional use as described in these Terms.
This license does not permit you to sublicense, resell, rent, lease, distribute, or otherwise make the App available to third parties, except as the App's intended functionality (sending automatic SMS replies) naturally involves communication with callers.
The App is distributed exclusively through Google Play. Your download, installation, and purchase through Google Play are also subject to the Google Play Terms of Service, which apply in addition to these Terms. Where there is a conflict specifically regarding matters governed by Google Play (such as payment processing or distribution), Google's applicable terms will govern that specific matter.
These Terms also apply to updates of the App, unless an update includes its own terms.
Intellectual Property Rights
The App, including its software, source code, design, user interface, trademarks, logos, and all related intellectual property, is owned by the Provider or its licensors and is protected by applicable intellectual property laws. Open-source components are used under their own licenses, listed in the App (About › Open-source licenses).
These Terms grant you only the limited license described in "Mobile Application License and App Store Terms" to use the App. No other rights are transferred to you. You must not copy, modify, distribute, or create derivative works based on the App except as expressly permitted by these Terms or by mandatory law.
Any auto-reply message text you write remains your own content; the Provider claims no ownership over it and, as described above, does not access or store it.
Changes, Interruptions and Availability
The App is provided "as is." The automatic reply function depends on factors outside the Provider's control, including the Android operating system, your device settings, battery optimization settings, app permissions you grant, network coverage, and your mobile operator's network and services. The Provider does not guarantee that any SMS will be successfully delivered.
Cooldown periods, daily/monthly limits, and paused hours are tools to help you manage automatic replies; they are not guarantees against unexpected additional messages, missed configurations, or related operator charges.
The Provider may update, modify, or change the App from time to time via Google Play, and may discontinue the App as described in "Updates and New Features". The Provider does not guarantee uninterrupted or error-free operation of the App.
Support is provided by email on a best-effort basis; no specific response time is guaranteed.
No Warranty
To the fullest extent permitted by applicable law, the App is provided without warranties of any kind, whether express or implied, including as to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted availability.
The App is not designed or intended for emergency communications or any situation where failure or delay in sending a message could cause serious harm. You must not rely on the App for emergency, safety-critical, or time-critical communication.
Nothing in this section limits any warranty or guarantee that cannot be excluded under mandatory consumer protection law applicable to you.
Limitation of Liability
To the fullest extent permitted by applicable law, the Provider is not liable for indirect, incidental, consequential, or special damages arising from or related to the use of the App, including but not limited to:
- messages that are not sent, delayed, or not delivered;
- additional or unexpected SMS charges incurred due to configuration, device behavior, or operator billing;
- charges imposed by your mobile network operator.
Where the Provider is found liable despite the above, the Provider's total liability to you is limited to a full refund of the price you paid for the App (the one-time unlock purchase), except to the extent that mandatory consumer protection law requires a different outcome.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, or liability arising from fraud or willful misconduct, to the extent such exclusion would be unlawful.
Term and Termination
These Terms apply for as long as you use the App. You may stop using the App at any time by uninstalling it.
If you breach these Terms, your license under "Mobile Application License and App Store Terms" ends and you must stop using the App. The Provider may enforce these Terms and claim damages in accordance with applicable law.
Governing Law and Consumer Rights
These Terms are governed by the laws of Finland. If you are a consumer, they do not limit your rights under mandatory consumer protection law, including the law of your country of residence where it applies.
If you have a complaint, contact hello@mesensei.com. Consumers may also bring a dispute before the Finnish Consumer Disputes Board (Kuluttajariitalautakunta) or the competent court, where mandatory law so provides.
Versions of These Terms
These Terms apply to version 1.4 of the App and are included in the App (About › Service Terms). A new version of the App may contain updated Terms, which apply to that version once you install it. If you do not agree with updated Terms, you should not install the new version.
